GENERAL TERMS AND CONDITIONS OF SALE

The general terms and conditions of sale detailed below only govern the contractual relationship between the User (hereafter referred to as the customer) and the trader (hereafter referred to as BADELAINE), the latter belonging to the company Badelaine Sarl with a capital of 3,000 Euros, whose headquarters are located 103 rue d’Aboukir, 75002 Paris, registered under business N° 791 805 781 and with VAT N° FR69791805781.

ART. 1 - Sales Conditions
When placing the order, the customer has read and accepted the terms and conditions - having paid particular attention to information about product description, price, quantity, colour, particularities and cost of services - and accepts them completely.

ART. 2 – Validity of Order
The present offer as shown on the website www.badelaine.com only addresses individual customers with a valid postal address in France or abroad.

ART. 3 - Order Confirmation 
Your order is confirmed upon receipt of the email “order processed”. The sale will be effective once the order is confirmed by BADELAINE and upon receipt by the customer of the email “shipment of your order”. This email will be sent to the customer within a maximum of three working days after the order has been processed. BADELAINE reserves the right not to confirm an order for any reason such as item availability, problems concerning the order received, abnormal order and/or delivery address, predictable problems concerning the delivery or issues concerning a previous order. In such situations, BADELAINE will inform the customer within a maximum of 5 working days after the order has been registered and a refund will be made. If we are only able to fulfil part of your order, payment will be taken for your whole order, and on dispatch, a full refund for the unavailable goods will be made.

ART. 4 - Prices
BADELAINE reserves the right to modify prices of the products at any time but will apply the prices as indicated on the website when a customer places an order. Products on sale will neither be refunded nor exchanged.

ART. 5 - Secure Payment  
Payments are made by credit card, debit card or via PayPal only. BADELAINE uses the Secure Socket Layer (SSL) technology to ensure that our customers’ information (name, address and other critically sensitive information like your credit card details) are crypted. BADELAINE is working with CREDIT AGRICOLE e-commerce system. Information passed between your computer and our website cannot be read in the event of it being intercepted. BADELAINE does not store your bank details on its website and payment does not go through the BADELAINE website. ART. 6 - Property  
Items remain BADELAINE’s full property until the complete collection of the payment has been received.

ART. 7 - Delivery terms  
BADELAINE aims to dispatch all orders as quickly as possible. Orders are usually sent on the following working day to which the customers place their order. Please allow a maximum of three working days for the processing and shipment of your order. Products are sent using the traditional postal network to the address indicated by the customer. Shipping costs vary according to country of destination and order amount. Reception time of the orders depends on countries of destination.

ART. 8 - Retraction  
Shall the customer decide to return part or all of the ordered products, the customer has the possibility to do so within 7 days after reception of the order. Prior to returning the goods, the customer will inform BADELAINE by email of his/her intention to return the goods. The present right of return only applies to products that are sent back to BADELAINE in their original condition, unworn and with all tickets and tags attached. Any damaged item, any item sent without its original packaging and/or any item displaying evidence of wear will not be refunded. BADELAINE advises the customer to return the products using a registered traceable service to avoid any risk of lost parcel. BADELAINE does not take responsibility for the cost of return. BADELAINE suggests that the customer includes invoice & reason for return to the parcel. BADELAINE will proceed to the refund within 30 days once the returned products have been received. BADELAINE will not accept any return for sale items.

ART. 9 - Privacy
Personal details provided by the customer are essential for the processing and delivery of orders, billing, establishing warranty contracts and enabling BADELAINE to provide good service. In accordance with the Data Processing and Freedom law, the processing of customer details are subjected to a declaration made before the CNIL (French computer data protection commission).   BADELAINE fully complies with all applicable Data Protection and consumer legislation, and will treat all customers’ personal information as fully confidential.

Customers have the permanent right to access and rectify all the information that concerns them, in accordance with European texts and national laws in place (France: article 34 of the law passed on January, 6th 1978).

ART. 10 - Intellectual Property  
The full content on www.badelaine.com is the property of BADELAINE. Any partial or total reproduction of this content is subjected to prior and express authorization by BADELAINE.

ART. 11 - Applicable law  
The above terms and conditions are expressed under French laws.
